1. Extent of application

Use of the website published by Max Weishaupt GmbH, 88475 Schwendi, Germany (hereafter the Weishaupt Website) is in exclusive accordance with these Terms of Use. These Terms of Use may be amended, extended, or replaced by other conditions where necessary, for instance for the purchase of products and/or services from Max Weishaupt GmbH . In using the Weishaupt Website you indicate your acceptance of the current version of the Terms of Use.

In so far as the user is not a consumer in the sense of section 13 of the German Civil Code [§13 BGB] then section 312e paragraph 1 sentence 1 Nos 1-3 of the German Civil Code [§312e Abs. 1 S. 1 Nr. 1-3 BGB] does not apply.

Max Weishaupt GmbH maintains certain information and software on the Weishaupt Website for access or for download. Max Weishaupt GmbH can cease operation of the Weishaupt Website partially or in whole at any time. We accept no liability for any interrupted availability of the Weishaupt Website. The information on the Weishaupt Website contains specifications and/or general descriptions of the technical potential of Max Weishaupt GmbH products. Such data are non-binding. We reserve the right to amend these data at any time.

Nevertheless we accept no responsibility for accuracy, freedom from error, copyright or property rights of third parties, or the completeness and usability of the content of the Weishaupt Website. We will not be held liable for breach of duty through slight carelessness, unless contractual obligations are affected, or damages to life, limb, or health arise, or claims fall within the scope of product liability law. This applies equally to breach of duty by our vicarious agents.

Use of the Weishaupt Website is at the user's own risk. We try to ensure the Weishaupt Website is virus-free, but cannot guarantee that it will be so. These Terms of Use for the Weishaupt Website shall be subject to and construed in accordance with German law. Court of jurisdiction is in 88400 Biberach, Germany, provided that the user is a merchant in the sense of the German Commercial Code [HGB], a legal person under public law, or legal entity under public law.
